Terms of Service

1. Who we are and what these terms cover

TradieCall is an AI-powered phone answering, message-taking, and booking service for trade businesses, operated by JXM Studio, New Zealand ("we", "us"). These terms are a contract between us and the business that signs up ("you"). By creating an account or subscribing you agree to them. The service is supplied for business purposes, not personal or household use.

2. The service

We answer calls on a phone number we provision for you, using an AI receptionist configured with the details you provide. The service captures caller details, takes messages, can pencil in bookings, and sends you summaries by SMS, email, and your dashboard. Your receptionist and number are set up automatically after checkout; occasionally number provisioning can take longer than usual, and we'll keep you updated in your dashboard if it does.

Not for emergency calls. The service cannot connect callers to 111 (or 000) and is not a substitute for emergency services.

3. Your responsibilities

  • Provide accurate business information and keep it up to date — the AI answers based on what you tell it, including any pricing you choose to enable.
  • Keep your login credentials secure. Actions taken through your account are yours.
  • Use the service lawfully. We may suspend numbers or accounts used for spam, abuse, harassment, or unlawful purposes.
  • If you divert your existing phone line to your TradieCall number, charges from your own phone carrier for diverted calls are your responsibility.

4. Free trial

New subscriptions start with a 7-day free trial that includes 30 AI answering minutes. A valid card is required to start the trial but is not charged until the trial ends. If you use all 30 trial minutes before day 7, answering pauses until your paid subscription starts. Cancel before the trial ends and you won't be charged.

5. Plans, usage, and billing

  • Each plan includes a monthly allowance of AI answering minutes (shown at checkout and in your dashboard). AI talk-time is measured per call and rounded up in 30-second increments.
  • Usage beyond your included minutes is billed at your plan's per-minute overage rate, unless you have enabled a hard cap, in which case answering pauses instead.
  • Subscriptions are billed in advance via Stripe in NZD (annual plans are billed yearly at the equivalent of 10 monthly payments). Prices include GST where applicable.
  • We'll email you as you approach and reach your included minutes. Plan changes take effect via the billing portal; upgrades apply immediately with proration.
  • If a payment fails we'll retry for a period before suspending the service.

6. Your number

The phone number we provision for you is licensed to you for use with the service while your subscription is active; it is provisioned and held through our telephony providers. After cancellation we keep the number reserved for 30 days in case you return, then it is released. If you want to port the number elsewhere, contact us before that grace period ends — porting depends on carrier support and isn't guaranteed.

7. Call recording and AI processing

Calls answered by the service are recorded and transcribed so we can provide your call log, summaries, and captured job details. Call audio and text are processed by our speech-to-text, language-model, and text-to-speech providers solely to handle the call. You are responsible for complying with the recording and privacy rules that apply to your business and callers in your location; we recommend disclosing recording in your greeting, and for Australian customers a recording notice is included in the default greeting.

8. Service levels and AI limitations

We aim for high availability but the service depends on telephony carriers, AI providers, and internet infrastructure we don't control, and we don't guarantee uninterrupted service. AI transcription and conversation can make mistakes — mishear a name, misjudge urgency, or answer imperfectly. Verify important details (addresses, callback numbers, quoted prices) before acting on them. Bookings taken by the AI are tentative holds until you confirm them.

9. Liability

You acquire the service in trade for business purposes, and to the maximum extent permitted by law the parties agree that the Consumer Guarantees Act 1993 does not apply and that the Fair Trading Act 1986 sections that may be excluded in trade are excluded. To the extent permitted by law, our total liability arising out of the service in any 12-month period is limited to the fees you paid us in the 3 months before the event giving rise to the claim, and we are not liable for indirect or consequential loss, including lost business, missed calls or bookings, or the content of AI conversations. Nothing in these terms limits liability that cannot lawfully be limited.

10. Cancellation and termination

You can cancel anytime from the billing portal; the service continues to the end of the period you've paid for and fees already paid are not refunded. We may terminate or suspend accounts that breach these terms, with notice where practicable. On termination you can export your call data from the dashboard; see our Privacy Policy for what happens to your data afterwards.

11. Changes

We may update these terms or plan pricing with at least 14 days' notice by email. Price changes take effect from your next billing period. Continued use after changes take effect constitutes acceptance.

12. General

These terms are governed by New Zealand law and the New Zealand courts have exclusive jurisdiction. If any part of these terms is unenforceable, the rest still applies.
